Z O.O.<\/span>\n <\/h1>\n Version 4.7 | In force from 29.10.2026<\/p>\n <\/div>\n\n <h2>\u00a7 1. GENERAL PROVISIONS<\/h2>\n\n 1.<\/span> These Regulations set out the rules for the delivery of development services and events organised by Centrum Kszta\u0142cenia Kadr Medycznych i Psychoterapii Sp. z o.o. (hereinafter referred to as \u2018CKKMIP\u2019 or the \u2018Service Provider\u2019), hereinafter jointly referred to as \u2018services\u2019, including, among others, training courses, courses, supervision, intervision, Balint groups, workshops, therapy groups and support groups, conferences, symposia and lectures, delivered in person, remotely (online) or in blended form, both as non-funded services and as services funded from public funds.<\/p>\n\n 1a.<\/span> The Regulations do not apply to healthcare services provided to patients, including therapy or support groups run as healthcare services; such services are subject to separate rules.<\/p>\n\n 2.<\/span> The Service Provider conducts training activities and activities in the field of development services, in person and remotely (online), in the areas of psychology, psychotherapy and related fields.<\/p>\n\n 3.<\/span> Training courses and development services are delivered in accordance with the applicable laws, including the Act of 20 April 2004 on the promotion of employment and labour market institutions, the Regulation of the Minister of Labour and Social Policy of 14 May 2014 on the detailed conditions for the delivery and the procedure and methods of providing labour market services, and in accordance with the requirements of the Development Services Database (BUR).<\/p>\n\n 4.<\/span> Services may be delivered as non-funded services or as funded services. A funded service is a service whose price is wholly or partly financed, reimbursed or covered by a Funding Body (including an Operator, a Labour Office, a foundation or another entity that is neither the Participant nor the Client) from public funds, including European funds, or from other external funds. A non-funded service is a service whose price is covered in full by the Participant or the Client from their own funds, including by an employer or a delegating institution.<\/p>\n\n 5.<\/span> The terms used in the Regulations mean:<\/p>\n\n <ul class=\"sub-list\">\n <li>a)<\/strong> \u2018BUR\u2019 \u2013 the Development Services Database (BUR) maintained by PARP;<\/li>\n <li>b)<\/strong> \u2018Service card\u2019 \u2013 the description of the service in BUR or on the website www.ckkmip.pl;<\/li>\n <li>c)<\/strong> \u2018Agreement\u2019 \u2013 an agreement concluded between the Service Provider and the Participant or the Client for the delivery of a service, including an agreement on cooperation in obtaining funding and on participation in the service;<\/li>\n <li>d)<\/strong> \u2018Client\u2019 or \u2018Ordering Party\u2019 \u2013 a natural person, legal person or organisational unit without legal personality that concludes an Agreement with the Service Provider (including an employer or a delegating institution); may be the same person as the Participant;<\/li>\n <li>e)<\/strong> \u2018Payer\u2019 \u2013 the entity obliged to pay the price of the service or part of it; may be the same person as the Participant or the Client;<\/li>\n <li>f)<\/strong> \u2018Consumer\u2019 \u2013 a natural person referred to in Article 22\u00b9 of the Civil Code;<\/li>\n <li>g)<\/strong> \u2018Operator\u2019 \u2013 the entity managing a programme of funding for development services from public funds;<\/li>\n <li>h)<\/strong> \u2018Labour Office\u2019 \u2013 a district or regional labour office, in particular with regard to the National Training Fund (KFS) or other resources of the Labour Fund;<\/li>\n <li>i)<\/strong> \u2018Funding Body\u2019 \u2013 an Operator, a Labour Office or another entity that finances the service in whole or in part from public or external funds;<\/li>\n <li>j)<\/strong> \u2018Participant\u2019 \u2013 a natural person taking part in the service who has obtained this status in accordance with point 19;<\/li>\n <li>k)<\/strong> \u2018Candidate\u2019 \u2013 a natural person who has submitted an application for a service and who remains in the recruitment process until obtaining the status of Participant in accordance with point 19.<\/li>\n <\/ul>\n\n 6.<\/span> CKKMIP is entered in the BUR database as a verified provider of development and advisory services and holds the SUS 3.0 training services standard certificate.<\/p>\n\n 7.<\/span> The Service Provider declares that it delivers development services in the fields of psychology and psychotherapy on the basis of training programmes accredited by an external certifying institution. Validation of learning outcomes, where provided for in the service card, is carried out independently of the learning process, on the terms set out in \u00a7 8.<\/p>\n\n <h2>\u00a7 2. ORGANIZATION OF TRAINING and DEVELOPMENT SERVICES<\/h2>\n\n 8.<\/span> The Service Provider publishes its service offer in the Development Services Database (BUR) in the form of a service card and offers its services on the website www.ckkmip.pl.<\/p>\n\n 9.<\/span> The service card in BUR contains detailed information about the service: goals, learning outcomes, program, schedule, form of implementation, price and conditions of participation.<\/p>\n\n 10.<\/span> Development services are carried out in a stationary, remote form (online in<\/p>\n\n 11.<\/span> The minimum number of participants in a development service is 6 people, unless the service card provides otherwise. The Service Provider reserves the right to cancel or reschedule classes if the minimum number of participants is not reached, on the terms set out in point 45a.<\/p>\n\n 12.<\/span> The Service Provider provides materials for participants in electronic form, unless the service card provides otherwise.<\/p>\n\n 13.<\/span> The Service Provider issues a certificate of completion of the development service within 14 days of its completion, provided that the Participant has met the requirements set out in the programme of the given service. Certificates issued within the price of the service are issued exclusively in electronic form in Polish. Certificates in paper form or in other language versions are issued and sent at the written request of the Participant for an additional fee. In the case of funded services, the certificate of completion serves as confirmation of participation or of learning outcomes and does not constitute a qualification certificate within the meaning of the Integrated Qualifications System, unless the service card or the certificate issued expressly provides otherwise.<\/p>\n\n 14.<\/span> The price of the service does not include ineligible costs, in particular: travel, accommodation, food or other costs related to the Participant's participation in the service, unless the service card<\/p>\n\n <h2>\u00a7 3. CONDITIONS OF PARTICIPATION and PAYMENT<\/h2>\n\n 15.<\/span> The condition for participation in a service is the submission of an application (in electronic or written form, including via the registration form, application form or agreement available on the website www.ckkmip.pl) and the fulfilment of the eligibility requirements set out in the service card and in these Regulations.<\/p>\n\n 16.<\/span> Applications for a selected service are made via the online form available on the website www.ckkmip.pl, the service card in BUR, the agreement, or in writing.<\/p>\n\n 17.<\/span> Submission of the application means acceptance of these Regulations and the obligation to<\/p>\n\n 18.<\/span> In the case of funded services, the Candidate (or, where funding is obtained by the employer, the Client) is obliged to submit an application for funding to the competent Funding Body before enrolling for the service in BUR, if the service is delivered using the BUR system. In the case of KFS, the application must be submitted before the service begins and is paid for.<\/p>\n\n 19.<\/span> The Candidate obtains the status of Participant upon the joint fulfilment of the following conditions: (a) in the case of funded services \u2013 obtaining a positive decision from the Funding Body (and, in the case of an Operator, also concluding an agreement with the Operator and obtaining a support ID number), correct enrolment for the service in the BUR database (if the service is delivered using the BUR database), concluding an Agreement with the Service Provider and approval of the enrolment by the Service Provider; (b) in the case of non-funded services \u2013 concluding an Agreement with the Service Provider. Enrolment in BUR is not equivalent to admission to the service; the Service Provider may reject or cancel it, in particular if there are no places available (within the limit set out in the service card) or if the requirements of \u00a7 12 are not met.<\/p>\n\n 20.<\/span> The payment rules and deadlines for participants using funding are set out in the agreement with the Funding Body, and for non-funded services \u2013 in the Agreement with the Service Provider. Depending on the funding programme, payment may comprise: (a) the Participant\u2019s own contribution paid to the Operator, (b) the Participant\u2019s own contribution paid to the Service Provider, (c) the full price of the service paid by the Participant to the Service Provider before the service begins, with subsequent reimbursement from the Operator, (d) the full price of the service paid by the Participant to the Service Provider after the service ends, with subsequent reimbursement from the Operator, (e) the full price of the service paid by the Client to the Service Provider, with subsequent refund of the funds to the Client by the Labour Office (in particular under KFS), whereby the refund of funds to the Client does not affect the obligation to pay the price to the Service Provider on time. Unless the agreement with the Funding Body or the service card provides otherwise, payment of the price of the service or of the own contribution to the Service Provider must be made no later than 14 days before the start date of the development service.<\/p>\n\n 21.<\/span> Detailed rules on payments and settlements in a given project and with a given Funding Body are provided to the Candidate before the application for funding is submitted.<\/p>\n\n 22.<\/span> In the case of non-funded services financed independently by the Participant or the Client, payment is made on the basis of a VAT invoice, within the deadline specified in the Agreement, but no later than 14 days before the planned start date of the service, unless the Agreement provides otherwise.<\/p>\n\n 22a.<\/span> Failure to pay within the deadline indicated in point 20 or 22 may result in refusal of admission to the service or termination of the Agreement after an ineffective request for payment within an additional period of 3 days, without prejudice to point 23a. Invoices are issued in the form required by law and are available in the National e-Invoicing System (KSeF). Invoices for Consumers, issued outside this system, are sent in electronic form to the e-mail address indicated in the Agreement, with acceptance of this method of delivery expressed in the Agreement; the Service Provider may ask for confirmation of receipt, but the absence of confirmation does not affect the effectiveness of delivery.<\/p>\n\n 22b.<\/span> In the case of services with a limited number of places, places are reserved in the order in which payments are booked, and the reservation is confirmed by e-mail. Failure to pay on time may result in refusal of admission, without prejudice to points 22a and 23a. For one-off events lasting no longer than two days, the service card or the offer may provide that a cancellation submitted at least 14 days before the start is free of charge, whereas a later cancellation results in the obligation to pay the full price.<\/p>\n\n 23.<\/span> The Participant is obliged to comply with the payment deadlines and conditions set out in the Agreement concluded with the Service Provider and \u2013 in the case of funded services \u2013 in the agreement with the Funding Body.<\/p>\n\n 23a.<\/span> Financial consequences of withdrawal from or termination of the agreement (unless the Agreement concluded with the Service Provider provides otherwise):<\/p>\n\n <ul class=\"sub-list\">\n <li>a)<\/strong> Withdrawal from or termination of the agreement submitted more than 45 days before the planned start date of the service \u2014 no financial consequences. Advance payments or prepayments made are refunded within 14 days of receipt of the notice.<\/li>\n <li>b)<\/strong> Withdrawal from or termination of the agreement submitted between 14 and 45 days before the planned start date of the service \u2014 the Service Provider deducts 50% of the price of the service on account of organisational costs incurred. The remaining amount is refunded within 14 days.<\/li>\n <li>c)<\/strong> Withdrawal from or termination of the agreement submitted less than 14 days before the planned start date of the service \u2014 the Participant, Client or Payer is obliged to pay the full cost of the service.<\/li>\n <li>d)<\/strong> Withdrawal from or termination of the agreement submitted during the service \u2014 the Participant, Client or Payer is obliged to pay the full cost of the service, regardless of the number of classes attended.<\/li>\n <li>e)<\/strong> Exclusion of the Participant from classes by decision of the Service Provider pursuant to \u00a7 7 point 47 of these Regulations \u2014 does not release the Participant from the obligation to pay the full cost of the service.<\/li>\n <li>f)<\/strong> The above provisions do not affect the Participant\u2019s statutory right to withdraw from a distance contract within 14 days of its conclusion, in accordance with the Consumer Rights Act \u2014 unless the agreement concluded with the Service Provider provides otherwise. If the Participant requested that performance begin before the end of the withdrawal period, in the event of withdrawal the Participant will pay for the performance rendered up to the moment of withdrawal, in an amount proportionate to the scope of the performance rendered.<\/li>\n <li>g)<\/strong> A notice of withdrawal from or termination of the agreement requires documentary form (Article 77\u00b2 of the Civil Code) and should be submitted electronically to szkolenia@ckkmip.pl, by registered letter or via the e-Delivery service to the address indicated in point 78. The date of submission of the notice is deemed to be the date of its receipt by the Service Provider, subject to point 79a.<\/li>\n <\/ul>\n\n 23b.<\/span> With the consent of the Service Provider, which will not be refused without good reason, the Client or the Participant may, no later than 3 days before the start of the service, nominate another person meeting the requirements of \u00a7 12 in place of the Participant; in such a case point 23a does not apply, and the payments made are credited towards the participation of the substitute person. With the consent of the Service Provider, payments may also be credited towards the same service on another date. In justified cases of unforeseen circumstances, the Service Provider may waive the deductions under point 23a in whole or in part. In the case of funded services, substitution of the Participant is possible only if permitted by the conditions of the Funding Body.<\/p>\n\n <h2>\u00a7 4. PARTICIPANT'S OBLIGATIONS<\/h2>\n\n 24.<\/span> Participant<\/p>\n\n <ul class=\"sub-list\">\n <li>a)<\/strong> active and engaged participation in the development service in accordance with the programme and schedule set out in the service card;<\/li>\n <li>b)<\/strong> compliance with health and safety rules and with the regulations of the venues where the services are delivered;<\/li>\n <li>c)<\/strong> respect for the copyright and intellectual property of the Service Provider and of the trainers;<\/li>\n <li>d)<\/strong> not sharing training materials with third parties without the written consent of the Service Provider;<\/li>\n <li>e)<\/strong> arriving punctually for classes and informing the Service Provider of absences in advance;<\/li>\n <li>f)<\/strong> courteous behaviour towards trainers, employees of the Service Provider and other participants;<\/li>\n <li>g)<\/strong> in the case of development services delivered online \u2013 participating with the camera switched on so that attendance can be identified, and signing in to the communication platform (e.g. Zoom) with full first name and surname, in accordance with the details provided in the application;<\/li>\n <li>h)<\/strong> in the case of funded services \u2013 enrolling for the service in BUR using the assigned support ID number before the service begins;<\/li>\n <li>i)<\/strong> in the case of funded services \u2013 completing the service evaluation survey in BUR within 7 days of the end of the service (this obligation is a necessary condition for settling the service with the Funding Body);<\/li>\n <li>j)<\/strong> providing, at their own expense, computer equipment with a working camera, microphone and stable internet connection, enabling active participation in classes delivered remotely in real time;<\/li>\n <li>k)<\/strong> promptly informing the Service Provider and \u2013 in the case of funded services \u2013 the competent Funding Body of any changes to personal data, employment status or other circumstances affecting the delivery of the service or the funding;<\/li>\n <li>l)<\/strong> not attending classes under the influence of alcohol or other intoxicating substances and not bringing them onto the premises where an in-person service is delivered;<\/li>\n <li>m)<\/strong> repairing, or covering the costs of repairing, any damage caused through their fault at the venue where the service takes place;<\/li>\n <li>n)<\/strong> promptly informing the Service Provider of any threats to life or health.<\/li>\n <\/ul>\n\n 25.<\/span> The service Participant undertakes to confirm their attendance in the manner indicated by the Service Provider or the trainer.<\/p>\n\n 26.<\/span> In the event of absence from classes exceeding 4 teaching hours (180 minutes) on a single day of classes, the Participant is obliged to make up the missed material in a manner agreed with the Service Provider. The total time of absence from classes may not exceed 10% of the duration of the service. The Service Provider may set a different limit of permitted absences in the service card or in the Agreement with the Participant, provided that an absence limit set by the Funding Body as a condition of funding may not be lowered.<\/p>\n\n <h2>\u00a7 5. MONITORING, RECORDING and DOCUMENTING ATTENDANCE<\/h2>\n\n 27.<\/span> Development services may be subject to inspection, monitoring or audit by the competent Funding Body, PARP, institutions accrediting the Service Provider or other external institutions.<\/p>\n\n 28.<\/span> The participant agrees to carry out<\/p>\n\n 29.<\/span> The Service Provider may record classes delivered remotely (online) for the following purposes: (a) archiving and documentation, (b) inspection and audit for the needs of Funding Bodies and supervisory institutions, (c) quality \u2013 to improve the teaching process.<\/p>\n\n 30.<\/span> Recordings of classes are not made available to Participants or third parties, unless required by law or by the agreement with the Funding Body.<\/p>\n\n 31.<\/span> The participant acknowledges that participation in the online service implies acceptance of the fact of recording the classes in accordance with the rules set out in points 29\u201330.<\/p>\n\n 32.<\/span> In the case of development services carried out remotely (online), the attendance of Participants (class log\/attendance list) is documented on the basis of the following sources:<\/p>\n\n <ul class=\"sub-list\">\n <li>a)<\/strong> a login report generated from the system used to host the meeting (e.g. Zoom), containing information on the times at which individual Participants joined and left the meeting;<\/li>\n <li>b)<\/strong> additional confirmation of attendance by the Participant entering their first name and surname in the \u2018meeting chat\u2019 function each day at specified times during classes;<\/li>\n <li>c)<\/strong> screenshots showing the participants, taken by the trainers, containing the computer\u2019s system date and time.<\/li>\n <\/ul>\n\n 32a.<\/span> In in-person services, attendance is documented on an attendance list, which the Participant signs personally on each day of classes; signing the list in advance is not permitted.<\/p>\n\n 33.<\/span> The attendance documentation referred to in points 32 and 32a constitutes the basis for confirming the Participant\u2019s participation in the development service for the purpose of issuing the certificate of completion and settling the service with the Funding Body (in the case of funded services). The Funding Body may set additional or different rules for documenting attendance (usually in the agreement with the Operator or in the programme regulations); in that case attendance is documented in accordance with both the Regulations and the rules of the Funding Body, and the Participant is obliged to comply with them, with point 80 applying.<\/p>\n\n 34.<\/span> The Participant acknowledges that failure to confirm attendance in accordance with the procedure described in point 32 or 32a may result in the given day of classes not being credited.<\/p>\n\n 35.<\/span> In the case of funded services, failure to comply with the attendance documentation rules set out in point 32 or 32a may result in the Funding Body rejecting the settlement of the service. In such a situation, participation in the service becomes an ineligible cost and the Funding Body will not settle the funding. The costs of participation (payment of the full price of the service) are then borne by the Participant or the Client.<\/p>\n\n 36.<\/span> Online services are delivered in real time via a communication platform, e.g. Zoom, unless the service card or offer indicates otherwise; access details are provided at least 1 day before the start of the service. Minimum technical requirements for services delivered online in real time, unless the service card provides otherwise:<\/p>\n\n <ul class=\"sub-list\">\n <li>a)<\/strong> a stable internet connection with a bandwidth of at least 5 Mb\/s download and 2 Mb\/s upload (10\/3 Mb\/s recommended), preferably wired or Wi-Fi with a good signal;<\/li>\n <li>b)<\/strong> a desktop computer or laptop (a tablet is acceptable) with at least a dual-core 2 GHz processor and 4 GB of RAM; a mobile phone is acceptable only if the service card so provides;<\/li>\n <li>c)<\/strong> a working webcam and a microphone and speakers or headphones (a headset with a microphone is recommended);<\/li>\n <li>d)<\/strong> an up-to-date browser (Chrome, Edge, Firefox or Safari) or the current version of the Zoom application, on an operating system supported by its manufacturer;<\/li>\n <li>e)<\/strong> no network or corporate restrictions preventing connection to the platform (e.g. Zoom), including firewalls and restrictions on access to the camera and microphone;<\/li>\n <li>f)<\/strong> a separate account and a separate device for each Participant; use of one account or device by more than one Participant is not permitted.<\/li>\n <\/ul>\n\n 37.<\/span> The Service Provider shall not be liable for the Participant's inability to attend classes resulting from the Participant's failure to meet the technical requirements set out in point 36 or from technical problems on the Participant's side.<\/p>\n\n <h2>\u00a7 6. USE OF ARTIFICIAL INTELLIGENCE TECHNOLOGY<\/h2>\n\n 38.<\/span> The Service Provider informs that the communication platforms used for remote real-time classes (e.g. Zoom) may offer built-in features based on artificial intelligence, such as:<\/p>\n\n <ul class=\"sub-list\">\n <li>a)<\/strong> AI Companion \u2013 an AI assistant for automatically generating notes and summaries;<\/li>\n <li>b)<\/strong> automatic transcription and translation of speech;<\/li>\n <li>c)<\/strong> automatic detection and identification of participants.<\/li>\n <\/ul>\n\n 39.<\/span> The Service Provider may use these features solely for the following purposes:<\/p>\n\n <ul class=\"sub-list\">\n <li>a)<\/strong> organisational: automatic meeting minutes, task lists, summaries for the teaching staff;<\/li>\n <li>b)<\/strong> quality-related: analysis of the course of classes in order to improve the programme;<\/li>\n <li>c)<\/strong> control-related: documentation for Funding Bodies and auditing institutions (in the case of funded services) or handling of a participant's complaint.<\/li>\n <\/ul>\n\n AI features are not used to identify Participants or to make decisions concerning a Participant. In the services referred to in point 48a, AI features are used only with the consent of all Participants in the given group.<\/p>\n\n 40.<\/span> Data processed by AI: AI tools may process Participants' voices, their statements (in audio and text form) and the first names and surnames visible in the communication application. Processing takes place in accordance with the privacy policy of the platform provider (e.g. Zoom) and with the GDPR.<\/p>\n\n 41.<\/span> Materials generated by AI are not made available to third parties other than the Service Provider and entities authorised to carry out inspections, unless required by law.<\/p>\n\n 42.<\/span> A Participant may at any time object to the processing of their data by AI tools (Article 21 GDPR) by contacting the Service Provider. The Service Provider shall consider the objection without undue delay and, if it is justified, shall disable AI features during classes attended by that Participant or delete or anonymise the AI-generated materials concerning that Participant (subject to archiving obligations).<\/p>\n\n 43.<\/span> The Participant confirms that they have read the information on the use of AI features contained in this paragraph.<\/p>\n\n <h2>\u00a7 7. RIGHTS OF THE SERVICE PROVIDER<\/h2>\n\n 44.<\/span> The Service Provider reserves the right to change the trainer conducting the classes, provided that the new trainer has appropriate qualifications and experience.<\/p>\n\n 45.<\/span> The Service Provider reserves the right to change the date or venue of classes for important reasons, informing Participants thereof with appropriate notice, subject to point 45a.<\/p>\n\n 45a.<\/span> If the Service Provider cancels a service or materially changes its date (in particular because the minimum number of participants has not been reached, due to illness of the person conducting it or force majeure), the Service Provider shall promptly inform the Participant or Client thereof and propose a new date or another service. If the Participant or Client does not accept the proposed solution, the Agreement shall be terminated and payments made shall be refunded within 14 days, without the deductions referred to in point 23a. Cancellation of a service because the minimum number of participants has not been reached shall take place no later than 7 days before the planned start date. Apart from refunding payments, the Service Provider shall not be liable for cancellation of the service, without prejudice to liability for wilful misconduct and to mandatory provisions of law. In the case of funded services, these rules shall apply taking into account the conditions of the Funding Body.<\/p>\n\n 46.<\/span> The Service Provider issues a certificate of completion of a development service only once the Participant has met all requirements set out in the programme, including the required attendance and taking the validation (where applicable).<\/p>\n\n 47.<\/span> The Service Provider reserves the right to exclude from participation in the service a Participant who breaches the provisions of these Regulations, disrupts the classes or behaves in a manner contrary to the principles of social coexistence. A Participant attending classes under the influence of alcohol or other intoxicating substances may be refused admission to classes or removed from them; the period of their absence shall be deemed an absence attributable to the Participant. Removal of a Participant for the above reasons does not release them from the obligation to pay for the service.<\/p>\n\n 48.<\/span> Teaching materials made available during development services are protected by copyright. The Participant may use the materials solely for their own educational purposes. Copying, distributing and commercial use of the materials is prohibited. The Participant may record parts of classes only with the prior written consent of the Service Provider and of the other participants, unless the law or the service card provides otherwise.<\/p>\n\n 48a.<\/span> In services involving supervision, intervision, Balint groups, practical exercises or case discussions, the Participant undertakes to: (a) keep confidential any information about other Participants and about the persons to whom the discussed cases relate obtained during the service; (b) present cases in a way that prevents identification of third parties and not introduce into the classes any data that would allow patients or clients to be identified; (c) not record the classes without the consent of the Service Provider and all Participants. The duty of confidentiality continues after the service has ended. The Participant decides independently on the extent of information they disclose about themselves.<\/p>\n\n 49.<\/span> The Service Provider shall not be liable for Participants' personal belongings brought to in-person classes or for damage resulting from circumstances beyond the Service Provider's control (force majeure, including theft, fire, flooding, infrastructure failures).<\/p>\n\n <h2>\u00a7 8. WALIDACJA<\/h2>\n\n 50.<\/span> Qualification training ends with a validation process, which includes verification of the Participant's achievement of the learning outcomes specified in the service card.<\/p>\n\n 51.<\/span> The validation process is separate from the education process and, unless the service card provides otherwise, may be carried out by:<\/p>\n\n <ul class=\"sub-list\">\n <li>a)<\/strong> the Service Provider, with the function of the person conducting the validation separated from the persons conducting the training process;<\/li>\n <li>b)<\/strong> an external entity independent of the training process, designated by the Service Provider.<\/li>\n <\/ul>\n\n 52.<\/span> Detailed validation rules, including the form and criteria for crediting, are specified in the service card.<\/p>\n\n 53.<\/span> Unless the agreement with the Funding Body provides otherwise, a negative validation result does not entail financial consequences for the Participant in the sense of reimbursement of costs or repayment of the service funding. The Participant has the right to retake the validation on the terms set by the Service Provider or by the external entity conducting the validation.<\/p>\n\n 54.<\/span> The issue of a certificate confirming qualifications or acquired competences depends on completing the development service and taking the validation (if applicable). The service card or the funding agreement may additionally make the issue of the certificate conditional on a positive validation result or require the validation result to be stated on the certificate.<\/p>\n\n 54a.<\/span> Obtaining additional qualifications, professional titles or certificates awarded by independent external institutions on the basis of the validation result does not form part of the Service. The Service Provider is not a party to such procedures and is not liable for their course or outcome.<\/p>\n\n <h2>\u00a7 9 COMPLAINTS<\/h2>\n\n 55.<\/span> The Participant has the right to submit a complaint regarding the implementation of the development service.<\/p>\n\n 56.<\/span> A complaint should be submitted in writing or electronically (to: szkolenia@ckkmip.pl) within 14 days of the end of the development service or of the occurrence of the situation, subject to point 79a.<\/p>\n\n 57.<\/span> The complaint should include: the Participant's data, the name of the development service, the date of implementation, a description of the objections and the expected manner of consideration.<\/p>\n\n 58.<\/span> The Service Provider shall consider the complaint within 30 days of its receipt and inform the Participant of how it has been resolved.<\/p>\n\n 59.<\/span> If the complaint is upheld, the Service Provider may offer: repetition of part of the classes, participation in the next edition of the service, a discount on further classes or another form of compensation.<\/p>\n\n <h2>\u00a7 10 Protection of personal data<\/h2>\n\n 60.<\/span> The administrator of the Participants' personal data is Centrum Kszta\u0142cenia Kadr Medycznych i Psychoterapii Sp. z o.o. with its registered office in Warsaw, ul. Wise\u0142ki 57, 04-830 Warsaw, KRS: 0001189925, nip: 95222731<\/p>\n\n 61.<\/span> Personal data is processed in accordance with Regulation (EU) 2016\/679 of the European Parliament and of the Council of 27 April 2016. (GDPR) and the Act of 10 May 2018 on the protection of personal data.<\/p>\n\n 62.<\/span> Personal data are processed for the purposes of: (a) delivering the development service, including organising and conducting the validation, (b) fulfilling the legal obligations of the Controller, (c) documenting and settling funded services, (d) archiving in accordance with applicable regulations.<\/p>\n\n 62a.<\/span> The legal basis for data processing is: Article 6(1)(b) GDPR (performance of the Agreement), point (c) (legal obligations, including tax obligations and those arising from agreements with Funding Bodies), point (f) (pursuit of claims, quality control of services, use of AI tools for the purposes referred to in point 39), and with regard to image \u2013 point (a) (consent).<\/p>\n\n 63.<\/span> Recipients of the data may include, among others: Funding Bodies, PARP, control and audit institutions, entities providing accounting, IT and hosting services, and external entities conducting the validation \u2013 to the extent necessary to conduct it and confirm its result. The Participant consents to the personal data contained in the application form being disclosed to contractors involved in organising the services (partners, sponsors) solely to the extent necessary to deliver the services.<\/p>\n\n 64.<\/span> The Service Provider may document the course of classes in the form of photographs or video materials for internal and promotional purposes. If a Participant does not consent to the use of their image in promotional materials, they must notify the Service Provider of this before or during the classes. The Service Provider then undertakes not to include that Participant's image in published materials or to anonymise the image (e.g. by blurring the face). Participation in classes constitutes consent to the incidental appearance of the Participant's image in group materials (photographs of the room, general shots), provided that it is not featured individually.<\/p>\n\n 65.<\/span> Data are stored for the duration of the Agreement and thereafter for the period resulting from legal regulations (including tax and archiving regulations), from the agreement with the Funding Body or from the programme rules, and with regard to data necessary to issue duplicate certificates \u2013 for the period necessary to issue them and until claims become time-barred.<\/p>\n\n 66.<\/span> The participant has the right to access, rectify, delete, limit processing, transfer data and object.<\/p>\n\n 67.<\/span> The Participant has the right to lodge a complaint with the President of the Office for Personal Data Protection.<\/p>\n\n 68.<\/span> Providing data is necessary to conclude and perform the Agreement and to fulfil legal obligations (including those arising from funding programmes); failure to provide them makes participation in the service impossible. Providing additional data is voluntary.<\/p>\n\n 68a.<\/span> The data are not subject to automated decision-making, including profiling. In connection with the use of communication platforms, data may be transferred outside the European Economic Area on the basis of mechanisms provided for in the GDPR.<\/p>\n\n 69.<\/span> Contact in matters of personal data protection: ckkmip@ckkmip.pl, tel. 22 350 77 77.<\/p>\n\n <h2>\u00a7 11. ACCESSIBILITY<\/h2>\n\n 70.<\/span> The Service Provider delivers development services taking into account the needs of persons with special needs and persons with disabilities, in accordance with the Accessibility Standards for Cohesion Policy 2021\u20132027.<\/p>\n\n 71.<\/span> The Candidate or Participant, as well as the person posting the employee with special functional needs, is obliged to report additional requirements related to disability\/special<\/p>\n\n 72.<\/span> The Service Provider will make every effort to adapt the form of delivery of classes to the needs reported, within its organisational and technical capabilities.<\/p>\n\n <h2>\u00a7 12. ELIGIBILITY REQUIREMENTS for TRAINING and DEVELOPMENT SERVICES IN the FIELD OF PSYCHOTHERAPY \/PSYCHOLOGICAL THERAPY<\/h2>\n\n 73.<\/span> Persons who meet the following conditions are eligible to participate in psychotherapy training:<\/p>\n\n A. TSR basic training (TSR 1):<\/strong><\/p>\n\n <ul class=\"sub-list\">\n <li>a)<\/strong> having at least secondary education,<\/li>\n <li>b)<\/strong> meeting at least one of the following conditions:<\/li>\n <li>employment or performance of work in one of the following areas: health care, psychology or psychotherapy, pedagogy and education, social assistance, justice and mediation, services<\/li>\n <li>pursuing higher education in the fields related to the above areas (at least the second year of study),<\/li>\n <li>in the process of certification as a TSR practitioner, therapist, psychotherapist or supervisor in a recognised psychotherapeutic association in one of the recognised approaches: systemic, cognitive (including cognitive-behavioural, schema and acceptance and commitment), humanistic-existential, psychodynamic or integrative.<\/li>\n <\/ul>\n\n B. TSR advanced training (TSR 2):<\/strong><\/p>\n\n Meeting the requirements set out in point A and holding the title of TSR Practitioner (or equivalent) awarded by an independent certifying institution, or a document confirming completion of basic training in solution-focused therapy of at least 70 teaching hours.<\/p>\n\n C. Subsequent stages of TSR training:<\/strong><\/p>\n\n Participation in further levels of training (specialist training, psychotherapy school, TSR supervisors course and others) requires meeting the requirements set out in point 73 A and B. Detailed additional qualification requirements for further levels of training are set out in the programmes of individual trainings, in line with the guidelines of the accreditation system referred to in point 7.<\/p>\n\n 74.<\/span> The detailed qualification requirements for individual development services of the Service Provider are set out in the service cards published in the BUR and in the offer on the website www.ckkmip.pl.<\/p>\n\n 75.<\/span> (repealed)<\/p>\n\n 76.<\/span> The Service Provider reserves the right to verify that the qualification requirements are met before accepting a Candidate for a development service.<\/p>\n\n <h2>\u00a7 13. RESIGNATION and WITHDRAWAL FROM the CONTRACT<\/h2>\n\n 77.<\/span> The financial consequences of withdrawing from participation in the service are set out in point 23a and in the Agreement. In the case of funded services, the financial consequences of withdrawal are set out in the agreement with the Funding Body and in the programme regulations.<\/p>\n\n 78.<\/span> Withdrawal must be submitted in documentary form (Article 77\u00b2 of the Civil Code) to szkolenia@ckkmip.pl, by registered letter or to the e-Delivery address AE:PL-15494-34789-VAUSG-33.<\/p>\n\n <h2>\u00a7 14. FINAL PROVISIONS<\/h2>\n\n 79.<\/span> In matters not covered by these Regulations, the provisions of the Civil Code and other relevant provisions of Polish law shall apply.<\/p>\n\n 79a.<\/span> The provisions of the Regulations apply to Consumers to the extent that they do not infringe mandatory provisions of law. The Regulations do not exclude or limit the rights granted to a Consumer by law, in particular the right to withdraw from an agreement concluded at a distance or off-premises, rights arising from non-conformity of the service with the agreement, and the right to pursue claims before the court having jurisdiction under generally applicable law. A Consumer's statement of withdrawal from the agreement is effective if it was sent before the withdrawal period expired.<\/p>\n\n 80.<\/span> In the case of funded services, in matters not regulated by these Regulations, the provisions of the agreement with the Funding Body (in the case of the KFS \u2013 the agreement on financing lifelong learning concluded by the Client with the district head (starosta), represented by the Labour Office) and the regulations of the funding programmes shall apply. In the event of discrepancies between the Regulations and the agreement with the Funding Body as regards the requirements imposed on the Participant, the Participant is obliged to meet the requirements of both documents and, where they differ, the more stringent requirements. Meeting the requirements of one document does not release the Participant from the obligation to meet the requirements of the other.<\/p>\n\n 81.<\/span> The Service Provider reserves the right to amend the Regulations. Amendments enter into force on the date indicated by the Service Provider, no earlier than 14 days from the date of publication.<\/p>\n\n 82.<\/span> Amendments to the Regulations do not affect Agreements concluded before the date on which the amendments enter into force; such Agreements are governed by the Regulations in the version in force on the date of their conclusion.<\/p>\n\n 83.<\/span> The parties undertake to resolve disputes arising from the delivery of development services amicably. Failing agreement, disputes shall be settled by the court having jurisdiction over the registered office of the Service Provider. The provision on court jurisdiction does not apply to Consumers; for them, court jurisdiction is determined by generally applicable law.<\/p>\n\n 84.<\/span> Version 4.7 of the Regulations enters into force on the day of its publication on the website ckkmip.pl, i.e. on the date indicated at the beginning of the Regulations. Z O.O.<\/span>\n <\/h1>\n Version 4.7 | In force from 29.10.2026<\/p>\n <\/div>\n\n <h2>\u00a7 1. GENERAL PROVISIONS<\/h2>\n\n 1.<\/span> These Regulations set out the rules for the delivery of development services and events organised by Centrum Kszta\u0142cenia Kadr Medycznych i Psychoterapii Sp. z o.o. (hereinafter referred to as \u2018CKKMIP\u2019 or the \u2018Service Provider\u2019), hereinafter jointly referred to as \u2018services\u2019, including, among others, training courses, courses, supervision, intervision, Balint groups, workshops, therapy groups and support groups, conferences, symposia and lectures, delivered in person, remotely (online) or in blended form, both as non-funded services and as services funded from public funds.<\/p>\n\n 1a.<\/span> The Regulations do not apply to healthcare services provided to patients, including therapy or support groups run as healthcare services; such services are subject to separate rules.<\/p>\n\n 2.<\/span> The Service Provider conducts training activities and activities in the field of development services, in person and remotely (online), in the areas of psychology, psychotherapy and related fields.<\/p>\n\n 3.<\/span> Training courses and development services are delivered in accordance with the applicable laws, including the Act of 20 April 2004 on the promotion of employment and labour market institutions, the Regulation of the Minister of Labour and Social Policy of 14 May 2014 on the detailed conditions for the delivery and the procedure and methods of providing labour market services, and in accordance with the requirements of the Development Services Database (BUR).<\/p>\n\n 4.<\/span> Services may be delivered as non-funded services or as funded services. A funded service is a service whose price is wholly or partly financed, reimbursed or covered by a Funding Body (including an Operator, a Labour Office, a foundation or another entity that is neither the Participant nor the Client) from public funds, including European funds, or from other external funds. A non-funded service is a service whose price is covered in full by the Participant or the Client from their own funds, including by an employer or a delegating institution.<\/p>\n\n 5.<\/span> The terms used in the Regulations mean:<\/p>\n\n <ul class=\"sub-list\">\n <li>a)<\/strong> \u2018BUR\u2019 \u2013 the Development Services Database (BUR) maintained by PARP;<\/li>\n <li>b)<\/strong> \u2018Service card\u2019 \u2013 the description of the service in BUR or on the website www.ckkmip.pl;<\/li>\n <li>c)<\/strong> \u2018Agreement\u2019 \u2013 an agreement concluded between the Service Provider and the Participant or the Client for the delivery of a service, including an agreement on cooperation in obtaining funding and on participation in the service;<\/li>\n <li>d)<\/strong> \u2018Client\u2019 or \u2018Ordering Party\u2019 \u2013 a natural person, legal person or organisational unit without legal personality that concludes an Agreement with the Service Provider (including an employer or a delegating institution); may be the same person as the Participant;<\/li>\n <li>e)<\/strong> \u2018Payer\u2019 \u2013 the entity obliged to pay the price of the service or part of it; may be the same person as the Participant or the Client;<\/li>\n <li>f)<\/strong> \u2018Consumer\u2019 \u2013 a natural person referred to in Article 22\u00b9 of the Civil Code;<\/li>\n <li>g)<\/strong> \u2018Operator\u2019 \u2013 the entity managing a programme of funding for development services from public funds;<\/li>\n <li>h)<\/strong> \u2018Labour Office\u2019 \u2013 a district or regional labour office, in particular with regard to the National Training Fund (KFS) or other resources of the Labour Fund;<\/li>\n <li>i)<\/strong> \u2018Funding Body\u2019 \u2013 an Operator, a Labour Office or another entity that finances the service in whole or in part from public or external funds;<\/li>\n <li>j)<\/strong> \u2018Participant\u2019 \u2013 a natural person taking part in the service who has obtained this status in accordance with point 19;<\/li>\n <li>k)<\/strong> \u2018Candidate\u2019 \u2013 a natural person who has submitted an application for a service and who remains in the recruitment process until obtaining the status of Participant in accordance with point 19.<\/li>\n <\/ul>\n\n 6.<\/span> CKKMIP is entered in the BUR database as a verified provider of development and advisory services and holds the SUS 3.0 training services standard certificate.<\/p>\n\n 7.<\/span> The Service Provider declares that it delivers development services in the fields of psychology and psychotherapy on the basis of training programmes accredited by an external certifying institution. Validation of learning outcomes, where provided for in the service card, is carried out independently of the learning process, on the terms set out in \u00a7 8.<\/p>\n\n <h2>\u00a7 2. ORGANIZATION OF TRAINING and DEVELOPMENT SERVICES<\/h2>\n\n 8.<\/span> The Service Provider publishes its service offer in the Development Services Database (BUR) in the form of a service card and offers its services on the website www.ckkmip.pl.<\/p>\n\n 9.<\/span> The service card in BUR contains detailed information about the service: goals, learning outcomes, program, schedule, form of implementation, price and conditions of participation.<\/p>\n\n 10.<\/span> Development services are carried out in a stationary, remote form (online in<\/p>\n\n 11.<\/span> The minimum number of participants in a development service is 6 people, unless the service card provides otherwise. The Service Provider reserves the right to cancel or reschedule classes if the minimum number of participants is not reached, on the terms set out in point 45a.<\/p>\n\n 12.<\/span> The Service Provider provides materials for participants in electronic form, unless the service card provides otherwise.<\/p>\n\n 13.<\/span> The Service Provider issues a certificate of completion of the development service within 14 days of its completion, provided that the Participant has met the requirements set out in the programme of the given service. Certificates issued within the price of the service are issued exclusively in electronic form in Polish. Certificates in paper form or in other language versions are issued and sent at the written request of the Participant for an additional fee. In the case of funded services, the certificate of completion serves as confirmation of participation or of learning outcomes and does not constitute a qualification certificate within the meaning of the Integrated Qualifications System, unless the service card or the certificate issued expressly provides otherwise.<\/p>\n\n 14.<\/span> The price of the service does not include ineligible costs, in particular: travel, accommodation, food or other costs related to the Participant's participation in the service, unless the service card<\/p>\n\n <h2>\u00a7 3. CONDITIONS OF PARTICIPATION and PAYMENT<\/h2>\n\n 15.<\/span> The condition for participation in a service is the submission of an application (in electronic or written form, including via the registration form, application form or agreement available on the website www.ckkmip.pl) and the fulfilment of the eligibility requirements set out in the service card and in these Regulations.<\/p>\n\n 16.<\/span> Applications for a selected service are made via the online form available on the website www.ckkmip.pl, the service card in BUR, the agreement, or in writing.<\/p>\n\n 17.<\/span> Submission of the application means acceptance of these Regulations and the obligation to<\/p>\n\n 18.<\/span> In the case of funded services, the Candidate (or, where funding is obtained by the employer, the Client) is obliged to submit an application for funding to the competent Funding Body before enrolling for the service in BUR, if the service is delivered using the BUR system. In the case of KFS, the application must be submitted before the service begins and is paid for.<\/p>\n\n 19.<\/span> The Candidate obtains the status of Participant upon the joint fulfilment of the following conditions: (a) in the case of funded services \u2013 obtaining a positive decision from the Funding Body (and, in the case of an Operator, also concluding an agreement with the Operator and obtaining a support ID number), correct enrolment for the service in the BUR database (if the service is delivered using the BUR database), concluding an Agreement with the Service Provider and approval of the enrolment by the Service Provider; (b) in the case of non-funded services \u2013 concluding an Agreement with the Service Provider. Enrolment in BUR is not equivalent to admission to the service; the Service Provider may reject or cancel it, in particular if there are no places available (within the limit set out in the service card) or if the requirements of \u00a7 12 are not met.<\/p>\n\n 20.<\/span> The payment rules and deadlines for participants using funding are set out in the agreement with the Funding Body, and for non-funded services \u2013 in the Agreement with the Service Provider. Depending on the funding programme, payment may comprise: (a) the Participant\u2019s own contribution paid to the Operator, (b) the Participant\u2019s own contribution paid to the Service Provider, (c) the full price of the service paid by the Participant to the Service Provider before the service begins, with subsequent reimbursement from the Operator, (d) the full price of the service paid by the Participant to the Service Provider after the service ends, with subsequent reimbursement from the Operator, (e) the full price of the service paid by the Client to the Service Provider, with subsequent refund of the funds to the Client by the Labour Office (in particular under KFS), whereby the refund of funds to the Client does not affect the obligation to pay the price to the Service Provider on time. Unless the agreement with the Funding Body or the service card provides otherwise, payment of the price of the service or of the own contribution to the Service Provider must be made no later than 14 days before the start date of the development service.<\/p>\n\n 21.<\/span> Detailed rules on payments and settlements in a given project and with a given Funding Body are provided to the Candidate before the application for funding is submitted.<\/p>\n\n 22.<\/span> In the case of non-funded services financed independently by the Participant or the Client, payment is made on the basis of a VAT invoice, within the deadline specified in the Agreement, but no later than 14 days before the planned start date of the service, unless the Agreement provides otherwise.<\/p>\n\n 22a.<\/span> Failure to pay within the deadline indicated in point 20 or 22 may result in refusal of admission to the service or termination of the Agreement after an ineffective request for payment within an additional period of 3 days, without prejudice to point 23a. Invoices are issued in the form required by law and are available in the National e-Invoicing System (KSeF). Invoices for Consumers, issued outside this system, are sent in electronic form to the e-mail address indicated in the Agreement, with acceptance of this method of delivery expressed in the Agreement; the Service Provider may ask for confirmation of receipt, but the absence of confirmation does not affect the effectiveness of delivery.<\/p>\n\n 22b.<\/span> In the case of services with a limited number of places, places are reserved in the order in which payments are booked, and the reservation is confirmed by e-mail. Failure to pay on time may result in refusal of admission, without prejudice to points 22a and 23a. For one-off events lasting no longer than two days, the service card or the offer may provide that a cancellation submitted at least 14 days before the start is free of charge, whereas a later cancellation results in the obligation to pay the full price.<\/p>\n\n 23.<\/span> The Participant is obliged to comply with the payment deadlines and conditions set out in the Agreement concluded with the Service Provider and \u2013 in the case of funded services \u2013 in the agreement with the Funding Body.<\/p>\n\n 23a.<\/span> Financial consequences of withdrawal from or termination of the agreement (unless the Agreement concluded with the Service Provider provides otherwise):<\/p>\n\n <ul class=\"sub-list\">\n <li>a)<\/strong> Withdrawal from or termination of the agreement submitted more than 45 days before the planned start date of the service \u2014 no financial consequences. Advance payments or prepayments made are refunded within 14 days of receipt of the notice.<\/li>\n <li>b)<\/strong> Withdrawal from or termination of the agreement submitted between 14 and 45 days before the planned start date of the service \u2014 the Service Provider deducts 50% of the price of the service on account of organisational costs incurred. The remaining amount is refunded within 14 days.<\/li>\n <li>c)<\/strong> Withdrawal from or termination of the agreement submitted less than 14 days before the planned start date of the service \u2014 the Participant, Client or Payer is obliged to pay the full cost of the service.<\/li>\n <li>d)<\/strong> Withdrawal from or termination of the agreement submitted during the service \u2014 the Participant, Client or Payer is obliged to pay the full cost of the service, regardless of the number of classes attended.<\/li>\n <li>e)<\/strong> Exclusion of the Participant from classes by decision of the Service Provider pursuant to \u00a7 7 point 47 of these Regulations \u2014 does not release the Participant from the obligation to pay the full cost of the service.<\/li>\n <li>f)<\/strong> The above provisions do not affect the Participant\u2019s statutory right to withdraw from a distance contract within 14 days of its conclusion, in accordance with the Consumer Rights Act \u2014 unless the agreement concluded with the Service Provider provides otherwise. If the Participant requested that performance begin before the end of the withdrawal period, in the event of withdrawal the Participant will pay for the performance rendered up to the moment of withdrawal, in an amount proportionate to the scope of the performance rendered.<\/li>\n <li>g)<\/strong> A notice of withdrawal from or termination of the agreement requires documentary form (Article 77\u00b2 of the Civil Code) and should be submitted electronically to szkolenia@ckkmip.pl, by registered letter or via the e-Delivery service to the address indicated in point 78. The date of submission of the notice is deemed to be the date of its receipt by the Service Provider, subject to point 79a.<\/li>\n <\/ul>\n\n 23b.<\/span> With the consent of the Service Provider, which will not be refused without good reason, the Client or the Participant may, no later than 3 days before the start of the service, nominate another person meeting the requirements of \u00a7 12 in place of the Participant; in such a case point 23a does not apply, and the payments made are credited towards the participation of the substitute person. With the consent of the Service Provider, payments may also be credited towards the same service on another date. In justified cases of unforeseen circumstances, the Service Provider may waive the deductions under point 23a in whole or in part. In the case of funded services, substitution of the Participant is possible only if permitted by the conditions of the Funding Body.<\/p>\n\n <h2>\u00a7 4. PARTICIPANT'S OBLIGATIONS<\/h2>\n\n 24.<\/span> Participant<\/p>\n\n <ul class=\"sub-list\">\n <li>a)<\/strong> active and engaged participation in the development service in accordance with the programme and schedule set out in the service card;<\/li>\n <li>b)<\/strong> compliance with health and safety rules and with the regulations of the venues where the services are delivered;<\/li>\n <li>c)<\/strong> respect for the copyright and intellectual property of the Service Provider and of the trainers;<\/li>\n <li>d)<\/strong> not sharing training materials with third parties without the written consent of the Service Provider;<\/li>\n <li>e)<\/strong> arriving punctually for classes and informing the Service Provider of absences in advance;<\/li>\n <li>f)<\/strong> courteous behaviour towards trainers, employees of the Service Provider and other participants;<\/li>\n <li>g)<\/strong> in the case of development services delivered online \u2013 participating with the camera switched on so that attendance can be identified, and signing in to the communication platform (e.g. Zoom) with full first name and surname, in accordance with the details provided in the application;<\/li>\n <li>h)<\/strong> in the case of funded services \u2013 enrolling for the service in BUR using the assigned support ID number before the service begins;<\/li>\n <li>i)<\/strong> in the case of funded services \u2013 completing the service evaluation survey in BUR within 7 days of the end of the service (this obligation is a necessary condition for settling the service with the Funding Body);<\/li>\n <li>j)<\/strong> providing, at their own expense, computer equipment with a working camera, microphone and stable internet connection, enabling active participation in classes delivered remotely in real time;<\/li>\n <li>k)<\/strong> promptly informing the Service Provider and \u2013 in the case of funded services \u2013 the competent Funding Body of any changes to personal data, employment status or other circumstances affecting the delivery of the service or the funding;<\/li>\n <li>l)<\/strong> not attending classes under the influence of alcohol or other intoxicating substances and not bringing them onto the premises where an in-person service is delivered;<\/li>\n <li>m)<\/strong> repairing, or covering the costs of repairing, any damage caused through their fault at the venue where the service takes place;<\/li>\n <li>n)<\/strong> promptly informing the Service Provider of any threats to life or health.<\/li>\n <\/ul>\n\n 25.<\/span> The service Participant undertakes to confirm their attendance in the manner indicated by the Service Provider or the trainer.<\/p>\n\n 26.<\/span> In the event of absence from classes exceeding 4 teaching hours (180 minutes) on a single day of classes, the Participant is obliged to make up the missed material in a manner agreed with the Service Provider. The total time of absence from classes may not exceed 10% of the duration of the service. The Service Provider may set a different limit of permitted absences in the service card or in the Agreement with the Participant, provided that an absence limit set by the Funding Body as a condition of funding may not be lowered.<\/p>\n\n <h2>\u00a7 5. MONITORING, RECORDING and DOCUMENTING ATTENDANCE<\/h2>\n\n 27.<\/span> Development services may be subject to inspection, monitoring or audit by the competent Funding Body, PARP, institutions accrediting the Service Provider or other external institutions.<\/p>\n\n 28.<\/span> The participant agrees to carry out<\/p>\n\n 29.<\/span> The Service Provider may record classes delivered remotely (online) for the following purposes: (a) archiving and documentation, (b) inspection and audit for the needs of Funding Bodies and supervisory institutions, (c) quality \u2013 to improve the teaching process.<\/p>\n\n 30.<\/span> Recordings of classes are not made available to Participants or third parties, unless required by law or by the agreement with the Funding Body.<\/p>\n\n 31.<\/span> The participant acknowledges that participation in the online service implies acceptance of the fact of recording the classes in accordance with the rules set out in points 29\u201330.<\/p>\n\n 32.<\/span> In the case of development services carried out remotely (online), the attendance of Participants (class log\/attendance list) is documented on the basis of the following sources:<\/p>\n\n <ul class=\"sub-list\">\n <li>a)<\/strong> a login report generated from the system used to host the meeting (e.g. Zoom), containing information on the times at which individual Participants joined and left the meeting;<\/li>\n <li>b)<\/strong> additional confirmation of attendance by the Participant entering their first name and surname in the \u2018meeting chat\u2019 function each day at specified times during classes;<\/li>\n <li>c)<\/strong> screenshots showing the participants, taken by the trainers, containing the computer\u2019s system date and time.<\/li>\n <\/ul>\n\n 32a.<\/span> In in-person services, attendance is documented on an attendance list, which the Participant signs personally on each day of classes; signing the list in advance is not permitted.<\/p>\n\n 33.<\/span> The attendance documentation referred to in points 32 and 32a constitutes the basis for confirming the Participant\u2019s participation in the development service for the purpose of issuing the certificate of completion and settling the service with the Funding Body (in the case of funded services). The Funding Body may set additional or different rules for documenting attendance (usually in the agreement with the Operator or in the programme regulations); in that case attendance is documented in accordance with both the Regulations and the rules of the Funding Body, and the Participant is obliged to comply with them, with point 80 applying.<\/p>\n\n 34.<\/span> The Participant acknowledges that failure to confirm attendance in accordance with the procedure described in point 32 or 32a may result in the given day of classes not being credited.<\/p>\n\n 35.<\/span> In the case of funded services, failure to comply with the attendance documentation rules set out in point 32 or 32a may result in the Funding Body rejecting the settlement of the service. In such a situation, participation in the service becomes an ineligible cost and the Funding Body will not settle the funding. The costs of participation (payment of the full price of the service) are then borne by the Participant or the Client.<\/p>\n\n 36.<\/span> Online services are delivered in real time via a communication platform, e.g. Zoom, unless the service card or offer indicates otherwise; access details are provided at least 1 day before the start of the service. Minimum technical requirements for services delivered online in real time, unless the service card provides otherwise:<\/p>\n\n <ul class=\"sub-list\">\n <li>a)<\/strong> a stable internet connection with a bandwidth of at least 5 Mb\/s download and 2 Mb\/s upload (10\/3 Mb\/s recommended), preferably wired or Wi-Fi with a good signal;<\/li>\n <li>b)<\/strong> a desktop computer or laptop (a tablet is acceptable) with at least a dual-core 2 GHz processor and 4 GB of RAM; a mobile phone is acceptable only if the service card so provides;<\/li>\n <li>c)<\/strong> a working webcam and a microphone and speakers or headphones (a headset with a microphone is recommended);<\/li>\n <li>d)<\/strong> an up-to-date browser (Chrome, Edge, Firefox or Safari) or the current version of the Zoom application, on an operating system supported by its manufacturer;<\/li>\n <li>e)<\/strong> no network or corporate restrictions preventing connection to the platform (e.g. Zoom), including firewalls and restrictions on access to the camera and microphone;<\/li>\n <li>f)<\/strong> a separate account and a separate device for each Participant; use of one account or device by more than one Participant is not permitted.<\/li>\n <\/ul>\n\n 37.<\/span> The Service Provider shall not be liable for the Participant's inability to attend classes resulting from the Participant's failure to meet the technical requirements set out in point 36 or from technical problems on the Participant's side.<\/p>\n\n <h2>\u00a7 6. USE OF ARTIFICIAL INTELLIGENCE TECHNOLOGY<\/h2>\n\n 38.<\/span> The Service Provider informs that the communication platforms used for remote real-time classes (e.g. Zoom) may offer built-in features based on artificial intelligence, such as:<\/p>\n\n <ul class=\"sub-list\">\n <li>a)<\/strong> AI Companion \u2013 an AI assistant for automatically generating notes and summaries;<\/li>\n <li>b)<\/strong> automatic transcription and translation of speech;<\/li>\n <li>c)<\/strong> automatic detection and identification of participants.<\/li>\n <\/ul>\n\n 39.<\/span> The Service Provider may use these features solely for the following purposes:<\/p>\n\n <ul class=\"sub-list\">\n <li>a)<\/strong> organisational: automatic meeting minutes, task lists, summaries for the teaching staff;<\/li>\n <li>b)<\/strong> quality-related: analysis of the course of classes in order to improve the programme;<\/li>\n <li>c)<\/strong> control-related: documentation for Funding Bodies and auditing institutions (in the case of funded services) or handling of a participant's complaint.<\/li>\n <\/ul>\n\n AI features are not used to identify Participants or to make decisions concerning a Participant. In the services referred to in point 48a, AI features are used only with the consent of all Participants in the given group.<\/p>\n\n 40.<\/span> Data processed by AI: AI tools may process Participants' voices, their statements (in audio and text form) and the first names and surnames visible in the communication application. Processing takes place in accordance with the privacy policy of the platform provider (e.g. Zoom) and with the GDPR.<\/p>\n\n 41.<\/span> Materials generated by AI are not made available to third parties other than the Service Provider and entities authorised to carry out inspections, unless required by law.<\/p>\n\n 42.<\/span> A Participant may at any time object to the processing of their data by AI tools (Article 21 GDPR) by contacting the Service Provider. The Service Provider shall consider the objection without undue delay and, if it is justified, shall disable AI features during classes attended by that Participant or delete or anonymise the AI-generated materials concerning that Participant (subject to archiving obligations).<\/p>\n\n 43.<\/span> The Participant confirms that they have read the information on the use of AI features contained in this paragraph.<\/p>\n\n <h2>\u00a7 7. RIGHTS OF THE SERVICE PROVIDER<\/h2>\n\n 44.<\/span> The Service Provider reserves the right to change the trainer conducting the classes, provided that the new trainer has appropriate qualifications and experience.<\/p>\n\n 45.<\/span> The Service Provider reserves the right to change the date or venue of classes for important reasons, informing Participants thereof with appropriate notice, subject to point 45a.<\/p>\n\n 45a.<\/span> If the Service Provider cancels a service or materially changes its date (in particular because the minimum number of participants has not been reached, due to illness of the person conducting it or force majeure), the Service Provider shall promptly inform the Participant or Client thereof and propose a new date or another service. If the Participant or Client does not accept the proposed solution, the Agreement shall be terminated and payments made shall be refunded within 14 days, without the deductions referred to in point 23a. Cancellation of a service because the minimum number of participants has not been reached shall take place no later than 7 days before the planned start date. Apart from refunding payments, the Service Provider shall not be liable for cancellation of the service, without prejudice to liability for wilful misconduct and to mandatory provisions of law. In the case of funded services, these rules shall apply taking into account the conditions of the Funding Body.<\/p>\n\n 46.<\/span> The Service Provider issues a certificate of completion of a development service only once the Participant has met all requirements set out in the programme, including the required attendance and taking the validation (where applicable).<\/p>\n\n 47.<\/span> The Service Provider reserves the right to exclude from participation in the service a Participant who breaches the provisions of these Regulations, disrupts the classes or behaves in a manner contrary to the principles of social coexistence. A Participant attending classes under the influence of alcohol or other intoxicating substances may be refused admission to classes or removed from them; the period of their absence shall be deemed an absence attributable to the Participant. Removal of a Participant for the above reasons does not release them from the obligation to pay for the service.<\/p>\n\n 48.<\/span> Teaching materials made available during development services are protected by copyright. The Participant may use the materials solely for their own educational purposes. Copying, distributing and commercial use of the materials is prohibited. The Participant may record parts of classes only with the prior written consent of the Service Provider and of the other participants, unless the law or the service card provides otherwise.<\/p>\n\n 48a.<\/span> In services involving supervision, intervision, Balint groups, practical exercises or case discussions, the Participant undertakes to: (a) keep confidential any information about other Participants and about the persons to whom the discussed cases relate obtained during the service; (b) present cases in a way that prevents identification of third parties and not introduce into the classes any data that would allow patients or clients to be identified; (c) not record the classes without the consent of the Service Provider and all Participants. The duty of confidentiality continues after the service has ended. The Participant decides independently on the extent of information they disclose about themselves.<\/p>\n\n 49.<\/span> The Service Provider shall not be liable for Participants' personal belongings brought to in-person classes or for damage resulting from circumstances beyond the Service Provider's control (force majeure, including theft, fire, flooding, infrastructure failures).<\/p>\n\n <h2>\u00a7 8. WALIDACJA<\/h2>\n\n 50.<\/span> Qualification training ends with a validation process, which includes verification of the Participant's achievement of the learning outcomes specified in the service card.<\/p>\n\n 51.<\/span> The validation process is separate from the education process and, unless the service card provides otherwise, may be carried out by:<\/p>\n\n <ul class=\"sub-list\">\n <li>a)<\/strong> the Service Provider, with the function of the person conducting the validation separated from the persons conducting the training process;<\/li>\n <li>b)<\/strong> an external entity independent of the training process, designated by the Service Provider.<\/li>\n <\/ul>\n\n 52.<\/span> Detailed validation rules, including the form and criteria for crediting, are specified in the service card.<\/p>\n\n 53.<\/span> Unless the agreement with the Funding Body provides otherwise, a negative validation result does not entail financial consequences for the Participant in the sense of reimbursement of costs or repayment of the service funding. The Participant has the right to retake the validation on the terms set by the Service Provider or by the external entity conducting the validation.<\/p>\n\n 54.<\/span> The issue of a certificate confirming qualifications or acquired competences depends on completing the development service and taking the validation (if applicable). The service card or the funding agreement may additionally make the issue of the certificate conditional on a positive validation result or require the validation result to be stated on the certificate.<\/p>\n\n 54a.<\/span> Obtaining additional qualifications, professional titles or certificates awarded by independent external institutions on the basis of the validation result does not form part of the Service. The Service Provider is not a party to such procedures and is not liable for their course or outcome.<\/p>\n\n <h2>\u00a7 9 COMPLAINTS<\/h2>\n\n 55.<\/span> The Participant has the right to submit a complaint regarding the implementation of the development service.<\/p>\n\n 56.<\/span> A complaint should be submitted in writing or electronically (to: szkolenia@ckkmip.pl) within 14 days of the end of the development service or of the occurrence of the situation, subject to point 79a.<\/p>\n\n 57.<\/span> The complaint should include: the Participant's data, the name of the development service, the date of implementation, a description of the objections and the expected manner of consideration.<\/p>\n\n 58.<\/span> The Service Provider shall consider the complaint within 30 days of its receipt and inform the Participant of how it has been resolved.<\/p>\n\n 59.<\/span> If the complaint is upheld, the Service Provider may offer: repetition of part of the classes, participation in the next edition of the service, a discount on further classes or another form of compensation.<\/p>\n\n <h2>\u00a7 10 Protection of personal data<\/h2>\n\n 60.<\/span> The administrator of the Participants' personal data is Centrum Kszta\u0142cenia Kadr Medycznych i Psychoterapii Sp. z o.o. with its registered office in Warsaw, ul. Wise\u0142ki 57, 04-830 Warsaw, KRS: 0001189925, nip: 95222731<\/p>\n\n 61.<\/span> Personal data is processed in accordance with Regulation (EU) 2016\/679 of the European Parliament and of the Council of 27 April 2016. (GDPR) and the Act of 10 May 2018 on the protection of personal data.<\/p>\n\n 62.<\/span> Personal data are processed for the purposes of: (a) delivering the development service, including organising and conducting the validation, (b) fulfilling the legal obligations of the Controller, (c) documenting and settling funded services, (d) archiving in accordance with applicable regulations.<\/p>\n\n 62a.<\/span> The legal basis for data processing is: Article 6(1)(b) GDPR (performance of the Agreement), point (c) (legal obligations, including tax obligations and those arising from agreements with Funding Bodies), point (f) (pursuit of claims, quality control of services, use of AI tools for the purposes referred to in point 39), and with regard to image \u2013 point (a) (consent).<\/p>\n\n 63.<\/span> Recipients of the data may include, among others: Funding Bodies, PARP, control and audit institutions, entities providing accounting, IT and hosting services, and external entities conducting the validation \u2013 to the extent necessary to conduct it and confirm its result. The Participant consents to the personal data contained in the application form being disclosed to contractors involved in organising the services (partners, sponsors) solely to the extent necessary to deliver the services.<\/p>\n\n 64.<\/span> The Service Provider may document the course of classes in the form of photographs or video materials for internal and promotional purposes. If a Participant does not consent to the use of their image in promotional materials, they must notify the Service Provider of this before or during the classes. The Service Provider then undertakes not to include that Participant's image in published materials or to anonymise the image (e.g. by blurring the face). Participation in classes constitutes consent to the incidental appearance of the Participant's image in group materials (photographs of the room, general shots), provided that it is not featured individually.<\/p>\n\n 65.<\/span> Data are stored for the duration of the Agreement and thereafter for the period resulting from legal regulations (including tax and archiving regulations), from the agreement with the Funding Body or from the programme rules, and with regard to data necessary to issue duplicate certificates \u2013 for the period necessary to issue them and until claims become time-barred.<\/p>\n\n 66.<\/span> The participant has the right to access, rectify, delete, limit processing, transfer data and object.<\/p>\n\n 67.<\/span> The Participant has the right to lodge a complaint with the President of the Office for Personal Data Protection.<\/p>\n\n 68.<\/span> Providing data is necessary to conclude and perform the Agreement and to fulfil legal obligations (including those arising from funding programmes); failure to provide them makes participation in the service impossible. Providing additional data is voluntary.<\/p>\n\n 68a.<\/span> The data are not subject to automated decision-making, including profiling. In connection with the use of communication platforms, data may be transferred outside the European Economic Area on the basis of mechanisms provided for in the GDPR.<\/p>\n\n 69.<\/span> Contact in matters of personal data protection: ckkmip@ckkmip.pl, tel. 22 350 77 77.<\/p>\n\n <h2>\u00a7 11. ACCESSIBILITY<\/h2>\n\n 70.<\/span> The Service Provider delivers development services taking into account the needs of persons with special needs and persons with disabilities, in accordance with the Accessibility Standards for Cohesion Policy 2021\u20132027.<\/p>\n\n 71.<\/span> The Candidate or Participant, as well as the person posting the employee with special functional needs, is obliged to report additional requirements related to disability\/special<\/p>\n\n 72.<\/span> The Service Provider will make every effort to adapt the form of delivery of classes to the needs reported, within its organisational and technical capabilities.<\/p>\n\n <h2>\u00a7 12. ELIGIBILITY REQUIREMENTS for TRAINING and DEVELOPMENT SERVICES IN the FIELD OF PSYCHOTHERAPY \/PSYCHOLOGICAL THERAPY<\/h2>\n\n 73.<\/span> Persons who meet the following conditions are eligible to participate in psychotherapy training:<\/p>\n\n A. TSR basic training (TSR 1):<\/strong><\/p>\n\n <ul class=\"sub-list\">\n <li>a)<\/strong> having at least secondary education,<\/li>\n <li>b)<\/strong> meeting at least one of the following conditions:<\/li>\n <li>employment or performance of work in one of the following areas: health care, psychology or psychotherapy, pedagogy and education, social assistance, justice and mediation, services<\/li>\n <li>pursuing higher education in the fields related to the above areas (at least the second year of study),<\/li>\n <li>in the process of certification as a TSR practitioner, therapist, psychotherapist or supervisor in a recognised psychotherapeutic association in one of the recognised approaches: systemic, cognitive (including cognitive-behavioural, schema and acceptance and commitment), humanistic-existential, psychodynamic or integrative.<\/li>\n <\/ul>\n\n B. TSR advanced training (TSR 2):<\/strong><\/p>\n\n Meeting the requirements set out in point A and holding the title of TSR Practitioner (or equivalent) awarded by an independent certifying institution, or a document confirming completion of basic training in solution-focused therapy of at least 70 teaching hours.<\/p>\n\n C. Subsequent stages of TSR training:<\/strong><\/p>\n\n Participation in further levels of training (specialist training, psychotherapy school, TSR supervisors course and others) requires meeting the requirements set out in point 73 A and B. Detailed additional qualification requirements for further levels of training are set out in the programmes of individual trainings, in line with the guidelines of the accreditation system referred to in point 7.<\/p>\n\n 74.<\/span> The detailed qualification requirements for individual development services of the Service Provider are set out in the service cards published in the BUR and in the offer on the website www.ckkmip.pl.<\/p>\n\n 75.<\/span> (repealed)<\/p>\n\n 76.<\/span> The Service Provider reserves the right to verify that the qualification requirements are met before accepting a Candidate for a development service.<\/p>\n\n <h2>\u00a7 13. RESIGNATION and WITHDRAWAL FROM the CONTRACT<\/h2>\n\n 77.<\/span> The financial consequences of withdrawing from participation in the service are set out in point 23a and in the Agreement. In the case of funded services, the financial consequences of withdrawal are set out in the agreement with the Funding Body and in the programme regulations.<\/p>\n\n 78.<\/span> Withdrawal must be submitted in documentary form (Article 77\u00b2 of the Civil Code) to szkolenia@ckkmip.pl, by registered letter or to the e-Delivery address AE:PL-15494-34789-VAUSG-33.<\/p>\n\n <h2>\u00a7 14. FINAL PROVISIONS<\/h2>\n\n 79.<\/span> In matters not covered by these Regulations, the provisions of the Civil Code and other relevant provisions of Polish law shall apply.<\/p>\n\n 79a.<\/span> The provisions of the Regulations apply to Consumers to the extent that they do not infringe mandatory provisions of law. The Regulations do not exclude or limit the rights granted to a Consumer by law, in particular the right to withdraw from an agreement concluded at a distance or off-premises, rights arising from non-conformity of the service with the agreement, and the right to pursue claims before the court having jurisdiction under generally applicable law. A Consumer's statement of withdrawal from the agreement is effective if it was sent before the withdrawal period expired.<\/p>\n\n 80.<\/span> In the case of funded services, in matters not regulated by these Regulations, the provisions of the agreement with the Funding Body (in the case of the KFS \u2013 the agreement on financing lifelong learning concluded by the Client with the district head (starosta), represented by the Labour Office) and the regulations of the funding programmes shall apply. In the event of discrepancies between the Regulations and the agreement with the Funding Body as regards the requirements imposed on the Participant, the Participant is obliged to meet the requirements of both documents and, where they differ, the more stringent requirements. Meeting the requirements of one document does not release the Participant from the obligation to meet the requirements of the other.<\/p>\n\n 81.<\/span> The Service Provider reserves the right to amend the Regulations. Amendments enter into force on the date indicated by the Service Provider, no earlier than 14 days from the date of publication.<\/p>\n\n 82.<\/span> Amendments to the Regulations do not affect Agreements concluded before the date on which the amendments enter into force; such Agreements are governed by the Regulations in the version in force on the date of their conclusion.<\/p>\n\n 83.<\/span> The parties undertake to resolve disputes arising from the delivery of development services amicably. Failing agreement, disputes shall be settled by the court having jurisdiction over the registered office of the Service Provider. The provision on court jurisdiction does not apply to Consumers; for them, court jurisdiction is determined by generally applicable law.<\/p>\n\n 84.<\/span> Version 4.7 of the Regulations enters into force on the day of its publication on the website ckkmip.pl, i.e. on the date indicated at the beginning of the Regulations.
